THE IMPORTANCE OF THE EUROPEAN CONVENTION FOR THE PROTECTION OF HUMAN RIGHTS AND FUNDAMENTAL FREEDOMS IN CONSTITUTIONAL LAW AND THE CONSTITUTIONAL SYSTEM OF THE REPUBLIC OF SERBIA

The paper analyzes the position of the European Convention in the Serbian national legal system within the framework provided by the new Serbian Constitution, which derives from the fact that our country has ratified the Declaration. The importance of the European Convention for constitutional law is discussed in the light of its specific legal nature, its position in comparative law, in particular in the system of constitutional law of the Republic of Serbia, and also in view of the activities of the Constitutional Court of Serbia, especially when it decides on constitutional appeals.

USTAVNOPRAVNI ZNAČAJ EVROPSKE KONVENCIJE ZA ZAŠTITU LJUDSKIH PRAVA I OSNOVNIH SLOBODA U USTAVNOM SISTEMU REPUBLIKE SRBIJE
U radu se analizira mesto Evropske konvencije u unutrašem pravnom sistemu u okvirima koji su postavljeni novim Ustavom Srbije, i koji proizilaze iz obaveza po osnovu prihvatanje Konvencije. Ustavnopravni značaj Evropske konvencije sagledan je u svetlu njene posebne pravne prirode, njenog mesta u uporednim, a posebno u ustavnopravnom sistemu Republike Srbije, kao i kroz postupanje Ustavnog suda Srbije, posebno onda kada odlučuje o ustavnim žalbma građana.
